By accessing, registering on, or using www.oceaniamatrimony.com.au,you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Platform.

 

These Terms are governed by Australian law. Your rights under the Australian Consumer Law (ACL) cannot be excluded, restricted, or modified by anything in this document.

1. Introduction and Acceptance of Terms

Welcome to Oceania Matrimony ('we', 'us', 'our', or the 'Platform') — Australia's most trusted matrimonial and matchmaking platform for Indians and South Asians worldwide, operated at www.oceaniamatrimony.com.au by Oceania Matrimony (ABN: 92 650 666 774), based in Harrisdale, Western Australia.

By accessing, browsing, registering on, or using the Platform in any way, you ('User', 'Member', or 'you') confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions ('Terms'), together with our Privacy Policy, Refund Policy, and Child Safety Policy, all of which are incorporated by reference.

If you do not agree to these Terms in their entirety, you must immediately cease using the Platform and must not register as a member.

 

Scope of Acceptance

These Terms apply to all members regardless of the country from which they access the Platform — including Australia, New Zealand, India, the United Kingdom, Ireland, Canada, the United States, the UAE, or any other country.

This Platform is strictly for matrimonial purposes only. It is not a dating platform. By registering, you confirm that you will use the Platform solely for genuine matrimonial intentions.

 

2. Governing Law — Australia

These Terms are governed primarily by the laws of the State of Western Australia and the Commonwealth of Australia. The following legislation applies:

Nothing in these Terms excludes, restricts, or modifies any right you have under the Australian Consumer Law, including statutory guarantees that cannot lawfully be excluded.

 

3. Eligibility and Registration

3.1  Age Requirement

You must be at least 18 years of age to register and use the Platform. There are no exceptions. By registering, you represent and warrant that:

       You are 18 years of age or older at the time of registration;

       You have full legal capacity to enter into a binding agreement;

       You are not prohibited by any court order, injunction, or law from using a matrimonial service;

       All information you provide during registration is accurate, current, and complete.

3.2  Who May Register

Oceania Matrimony membership is open to:

       Indian nationals and citizens;

       Non-Resident Indians (NRI) and Persons of Indian Origin (PIO);

       Any individual worldwide seeking a matrimonial match with the Indian community;

       Parents, guardians, siblings, or relatives registering on behalf of a prospective bride or groom, provided they have obtained the explicit consent of the person whose profile is being registered.

 

Organisations, companies, businesses, and individuals engaged in similar or competitive businesses may not register as members or use Platform data for any commercial purpose.

3.3  Marital Status

You must accurately disclose your marital status as: Single, Divorced, or Widowed. Divorced applicants may register by stating 'Awaiting Divorce' if divorce proceedings are underway, but must provide supporting documentation if requested. Providing false marital status information is a material breach of these Terms and may constitute an offence under Australian law.

3.4  One Profile Per Person

Only one profile per person is permitted on the Platform. Duplicate profiles of the same individual are prohibited. We reserve the right to suspend or permanently delete all duplicate profiles without notice and without refund of any subscription fees paid.

3.5  Profile Activation

All profiles — free and paid — are subject to manual review and verification by our team before activation. We reserve the right to decline activation of any profile that does not meet our standards, without providing a reason.

 

4. Profile Creation and Accuracy

4.1  Accuracy of Information

You are solely responsible for the accuracy, completeness, and currency of all information in your profile. This includes but is not limited to: name, date of birth, photographs, marital status, educational qualifications, employment details, income range, and family background.

 

We expect you to create your profile with fairness and honesty. We may, at any time, require you to provide documentary evidence supporting information in your profile (such as ID proof, qualifications, or divorce documentation). Failure to provide such evidence may result in suspension or deletion of your profile.

4.2  Photographs

Profile photographs must:

       Be recent photographs (taken within the last 12 months) of yourself only;

       Clearly show your face;

       Not include other people, children, obscene or inappropriate content;

       Not be artificially generated, manipulated, or altered using AI or similar technology (see Section 10).

4.3  Identity Verification

We may request a copy of a government-issued photo ID (such as an Australian Passport, Driver's Licence, or equivalent) to verify your identity, age, or name. Your name and date of birth displayed on the Platform will reflect your verified ID document. Profiles where ID verification is requested but not provided within the specified timeframe may be deactivated without further notice.

4.4  Profile Ownership

Your membership and profile are strictly personal. They may not be assigned, transferred, or used by any other person or entity. A profile registered on behalf of another person (by a parent or relative) remains the responsibility of the person whose matrimonial details are represented.

4.5  Profile Deletion After Marriage

Members are required to delete their profile or notify us immediately upon the confirmation of their marriage or engagement. You may notify us at info@oceaniamatrimony.com.au. Profiles of members who have confirmed their marriage will be deactivated and removed from public search results without further notice.

 

5. Account Security

You are solely responsible for maintaining the confidentiality of your account login credentials — including your username, password, and any OTPs or verification codes. You agree to:

       Create a strong password using a combination of upper and lower case letters, numbers, and symbols;

       Never share your password, OTP, or verification codes with any other person;

       Log out of your account after each session, particularly on shared or public devices;

       Notify us immediately at info@oceaniamatrimony.com.au if you become aware of any unauthorised access to your account.

Oceania Matrimony will never ask you for your password. You should not share your password with anyone claiming to represent us. We are not liable for any loss arising from your failure to maintain account security or from your sharing of credentials with a third party.

 

6. Scope of Service

6.1  What We Provide

Oceania Matrimony provides an online matrimonial matchmaking platform that enables members to:

       Create and manage a matrimonial profile;

       Search and browse other members' profiles;

       Express interest in and communicate with compatible profiles;

       Receive curated match suggestions based on their stated preferences.

6.2  What We Do Not Guarantee

We are a platform facilitator only. We do not:

       Guarantee that use of the Platform will result in a matrimonial match or marriage;

       Independently verify the accuracy of all information provided by members in their profiles;

       Guarantee the compatibility, character, or suitability of any member;

       Act as a licensed marriage celebrant, relationship counsellor, or broker.

The responsibility for verifying a prospective partner's credentials — including marital status, educational qualifications, employment, financial status, and character — rests entirely with the member and their family.

6.3  Platform as Intermediary

Oceania Matrimony operates as an online intermediary platform. We provide the interface and tools that enable members to search for and connect with each other. We are not a party to, and have no responsibility for, any communications, introductions, or arrangements made between members through or outside the Platform.

 

7. Member Responsibilities and Code of Conduct

All members must engage on the Platform with respect, honesty, and good faith. By using the Platform you agree to:

 

       Treat all other members, their families, and our staff with courtesy and respect at all times;

       Provide accurate and up-to-date information in your profile and update it whenever your circumstances change;

       Verify the credentials and background of any prospective match before making a decision — including marital status, qualifications, employment, and character;

       Exercise caution in sharing personal information and in meeting prospective matches offline;

       Refrain from entering into any financial transactions with other members — you must not seek or provide money, gifts, loans, or financial assistance to or from any member you meet through the Platform;

       Disclose any pre-existing health conditions, disabilities, or other material circumstances that a prospective partner and their family would reasonably need to know before proceeding with a match;

       Delete your profile or notify us promptly when your marriage is confirmed;

       Not use the Platform as a means to communicate details of other matrimonial websites or competing services;

       Not contact or attempt to contact any Platform staff member in an inappropriate or harassing manner.

 

8. Prohibited Activities

The following activities are strictly prohibited on the Platform. Any breach may result in immediate account termination, referral to law enforcement, and legal action:

You must NOT:

•  Provide false, misleading, or deceptive information in your profile or communications

•  Impersonate any person or create a profile on behalf of another without their consent

•  Upload AI-generated, manipulated, or synthetic photographs or content (see Section 10)

•  Harass, stalk, intimidate, threaten, abuse, or send unsolicited messages to any member

•  Post or transmit sexually explicit, obscene, pornographic, or offensive content

•  Use the Platform for commercial solicitation, advertising, or multi-level marketing

•  Collect, store, or use other members' personal information for any commercial or

   unlawful purpose

•  Use automated scripts, bots, web crawlers, or scraping tools to access Platform data

•  Attempt to reverse-engineer, decompile, or probe the Platform's technical systems

•  Upload or transmit any virus, malware, or content designed to damage or disrupt systems

•  Post content that is discriminatory, racially vilifying, or incites hatred

•  Violate any Australian law, including the Criminal Code Act 1995 (Cth) and the

   Online Safety Act 2021 (Cth)

•  Send any unsolicited bulk communications (spam) to other members

•  Post misleading information about your age, income, qualifications, or employment

 

9. Privacy and Data Protection

9.1  Privacy Act 1988 (Cth) Compliance

We are fully committed to protecting your personal information in accordance with the privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs). Our full Privacy Policy is available at pro.oceaniamatrimony.com.au/privacy-policy and forms part of these Terms.

9.2  Sensitive Information

Information including religious beliefs, cultural background, racial or ethnic origin, and health information is classified as 'sensitive information' under the Privacy Act 1988 (Cth). We collect such information only with your explicit consent and use it solely for the purpose of matrimonial matchmaking. We never use sensitive information for marketing or disclose it to third parties without your consent.

9.3  Communications Consent

By registering on the Platform and providing your contact details (mobile number, email address, WhatsApp number), you expressly consent to receive communications from Oceania Matrimony for service-related purposes including:

       Profile verification and account activation;

       Customer support and platform guidance;

       Matchmaking assistance and membership servicing;

       Billing notices and transaction confirmations;

       Safety alerts and important platform updates.

Promotional and marketing communications will only be sent with your consent and in compliance with the Spam Act 2003 (Cth). You may opt out of non-essential promotional communications at any time. Essential service communications may continue where required for service delivery.

9.4  Your Privacy Rights

Under the Privacy Act 1988 (Cth) you have the right to:

       Access personal information we hold about you (APP 12);

       Request correction of inaccurate or incomplete information (APP 13);

       Opt out of direct marketing communications at any time;

       Lodge a privacy complaint with us or with the OAIC (www.oaic.gov.au | 1300 363 992).

9.5  Profile Visibility

Your profile information — as configured by your privacy settings — is visible to other registered members for the purpose of matrimonial matchmaking. Member profiles may also be indexed by search engines. You can manage your profile visibility through your account privacy settings.

 

10. Synthetically Generated Information — AI Content Policy

10.1  Prohibition on AI-Generated Content

You must not upload, publish, or share any content on the Platform that is synthetically generated, manipulated, or altered using artificial intelligence, machine learning, deepfake technology, or any similar automated process ('Synthetically Generated Information' or 'SGI'). This includes but is not limited to:

       AI-generated profile photographs or images;

       Deepfake videos or manipulated imagery;

       AI-written profile descriptions that misrepresent the member;

       Any content that impersonates a real person without their authorisation.

10.2  Detection and Enforcement

We reserve the right to use automated and manual tools to detect SGI. Uploading or sharing SGI constitutes a material breach of these Terms and will result in:

       Immediate removal of the content;

       Suspension or permanent termination of the member's account without refund;

       Reporting to relevant Australian authorities where the content may constitute an offence.

 

11. Services, Subscriptions, and Payments

11.1  Free Membership

Free membership allows members to create a profile, browse profiles, and send a limited number of expressions of interest. Free membership is subject to daily and total usage limits as set by the Platform from time to time. Free membership does not give access to premium features such as full contact details, unlimited messaging, or live chat.

11.2  Paid Membership Plans

Oceania Matrimony offers the following paid plans:

Gold Membership:     AUD $50.00 (inclusive of GST)  —  6 months

Diamond Membership:  AUD $100.00 (inclusive of GST)  —  12 months

 

Paid features include (depending on plan):

  •  Access to member contact details  •  Expanded daily messaging

  •  Live text chat  •  Advanced search filters

  •  Priority profile visibility  •  Dedicated customer care

 

All prices are in Australian Dollars (AUD) and are inclusive of Goods and

Services Tax (GST) at 10% under the A New Tax System (Goods and Services

Tax) Act 1999 (Cth). GST tax invoices are issued by email upon payment.

11.3  Payment

By subscribing to a paid plan, you authorise us to charge the applicable fee to your nominated payment method. Payments are processed securely via our PCI-DSS certified payment gateway. We do not store raw card data on our servers.

11.4  Membership Validity

Paid memberships are valid from the date of activation until the end of the applicable plan period (6 or 12 months). Unused features, messages, or contact views do not carry over after the plan expires. Memberships are not automatically renewed unless you actively choose to renew.

11.5  Profile Expiry and Data Retention

Active profiles that have not been renewed or updated within 12 months of their expiry date may be permanently deleted. Profile photographs and detailed profile data will be removed. Only basic identifiers (profile ID, email address, mobile number, registration date) may be retained for compliance and fraud prevention purposes, in accordance with our Privacy Policy.

 

12. Australian Consumer Guarantees

Our services come with guarantees under the Australian Consumer Law (ACL) — Schedule 2 of the Competition and Consumer Act 2010 (Cth) — that cannot be excluded by these Terms or any other document.

       Services will be provided with due care and skill — section 60 ACL;

       Services will be fit for the purpose we have represented them to be — section 61 ACL;

       Where a major failure occurs, you are entitled to a full refund — section 267 ACL;

       Where a minor failure occurs, you are entitled to a remedy — repair of the failure or compensation;

       Misleading or deceptive conduct is prohibited — section 18 ACL;

       Unfair contract terms are void — Part 2-3 ACL.

13. Refund Policy

Subject to your non-excludable rights under the Australian Consumer Law, the following refund principles apply:

       Membership fees are generally non-refundable once a paid plan has been activated and you have commenced use of the paid features.

       We are not required to provide a refund for change of mind, if you find a partner through another source, or if you voluntarily close your account before the plan period ends.

       Refund requests must be submitted to info@oceaniamatrimony.com.au within 14 days of the relevant transaction, with supporting details.

14. Intellectual Property

All content on the Platform — including text, graphics, logos, software, database compilations, search algorithms, and design elements — is owned by or licensed to Oceania Matrimony and is protected under the Copyright Act 1968 (Cth) and the Trade Marks Act 1995 (Cth).

You retain ownership of content you upload to your profile (including photographs and written descriptions). By uploading content, you grant Oceania Matrimony a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content solely for the purpose of operating and promoting the Platform. This licence terminates when you remove the content from your profile or close your account.

You must not: copy, reproduce, distribute, commercially exploit, reverse-engineer, decompile, or create derivative works from any Platform content without our prior written consent. Violations may result in account termination and legal action.

 

15. Member Safety and Wellbeing

Your safety is our highest priority. We strongly recommend all members follow these safety guidelines:

       Meet a prospective match for the first time in a busy, well-lit public place — a café, restaurant, or shopping centre during busy hours;

       Arrange your own transport to and from every meeting — do not depend on the other person for transport to or from your home;

       Inform a trusted friend or family member of the person's name, meeting location, and your estimated return time before every meeting;

       Never share your financial information, bank details, or credit card information with any match;

       Never send money, gift cards, or financial assistance to any person you have met through the Platform, regardless of the reason given;

       Report any suspicious, threatening, abusive, or concerning behaviour to us immediately at info@oceaniamatrimony.com.au;

       Be alert to profiles that seem too good to be true, that avoid video calls or family involvement, or that request money or favours.

16. Child Safety — CSAE Policy

Oceania Matrimony maintains a zero-tolerance policy toward child sexual abuse and exploitation (CSAE) in any form. This Platform is strictly for persons aged 18 and over.

       No person under the age of 18 may register, create a profile, or use any feature of the Platform under any circumstances;

       Any content, communication, or behaviour involving or targeting a minor is strictly prohibited and will be reported immediately to the Australian Federal Police (AFP) and the eSafety Commissioner;

       Any content that depicts, promotes, or exploits children in any form — including CSAM (Child Sexual Abuse Material) — will result in immediate permanent account termination and mandatory law enforcement reporting;

       We use automated tools and manual moderation to detect and prevent CSAM from being uploaded or shared;

       Criminal penalties under the Criminal Code Act 1995 (Cth) for online child abuse offences include up to 15 years imprisonment.

17. Cybersecurity and Data Security

17.1  Our Security Measures

We implement security measures consistent with the Australian Cyber Security Centre (ACSC) Essential Eight framework and ISO/IEC 27001 principles, including:

       Transport Layer Security (TLS 1.2/1.3) encryption for all data in transit;

       AES-256 encryption for sensitive personal data stored at rest;

       Multi-factor authentication (MFA) options for all member accounts;

       Regular independent penetration testing and security audits;

       Role-based access controls and least-privilege principles;

       PCI-DSS compliant payment processing — raw card data is never stored on our systems.

17.2  Notifiable Data Breaches

We comply with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988 (Cth). In the event of an eligible data breach likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.

17.3  Your Security Responsibilities

Use a strong, unique password. Enable MFA where available. Log out after each session on shared devices. Notify us immediately of any suspected unauthorised access. Do not use bots, automated scripts, or vulnerability scanning tools against the Platform.

 

18. Electronic Communications Compliance

All electronic communications from Oceania Matrimony comply with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth):

       Commercial electronic messages are sent only with your express or inferred consent;

       Every marketing email includes a clearly functional unsubscribe link;

       We do not make unsolicited telemarketing calls to numbers registered on the Australian Do Not Call Register;

       You may opt out of marketing communications at any time by clicking 'Unsubscribe' in any email, or contacting info@oceaniamatrimony.com.au;

       Transactional messages (billing, verification, account security alerts) are essential service messages and are not subject to unsubscribe requests.

 

19. Monitoring and Content Moderation

Oceania Matrimony reserves the right — but is not obligated — to review, monitor, and moderate all profile content, messages, and member activity on the Platform to ensure compliance with these Terms and applicable Australian law.

We may, at our sole discretion and without prior notice:

       Remove or edit any content that violates these Terms, is offensive, false, misleading, or harmful;

       Request documentary evidence to verify information in a member's profile;

       Suspend or terminate any profile that breaches these Terms;

       Report content or conduct to Australian law enforcement authorities where required or appropriate.

Members are encouraged to report any content or behaviour they believe violates these Terms using the 'Report' feature on the Platform or by emailing info@oceaniamatrimony.com.au.

 

20. Third-Party Links and Services

The Platform may contain links to third-party websites or services. Oceania Matrimony does not control, endorse, or accept responsibility for any third-party website, content, or service. Your use of any third-party site is at your own risk and subject to that site's own terms and privacy policy.

Where we use third-party service providers (including payment gateways, analytics, cloud hosting, or SMS services), those providers are engaged under binding data processing agreements consistent with our obligations under the Privacy Act 1988 (Cth).

 

21. Limitation of Liability and Disclaimers

To the maximum extent permitted by Australian law, and subject always to your non-excludable rights under the ACL:

       The Platform is provided on an 'as is' and 'as available' basis. We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components;

       We are not responsible for the accuracy of information provided by other members in their profiles, including marital status, qualifications, employment, or character;

       We are not responsible for the conduct — online or offline — of any member, including any communications or meetings that occur through or following introduction on the Platform;

       We are not responsible for any financial transaction between members or between a member and a third party;

       We are not liable for any failure or delay in performance resulting from events beyond our reasonable control (force majeure), including natural disasters, government actions, or telecommunications failures;

       Our total aggregate liability for any claim arising under or in connection with these Terms shall not exceed the total fees paid by you in the 12 months immediately preceding the claim.

 

Nothing in this section limits any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

 

22. Indemnity

You agree to indemnify, defend, and hold harmless Oceania Matrimony, its directors, officers, employees, and agents from and against any loss, damage, cost, liability, or expense (including reasonable legal fees) arising from or relating to:

       Any breach of these Terms by you;

       Any content you upload, post, or transmit through the Platform;

       Any false or misleading information you provide in your profile;

       Any fraudulent, unlawful, or improper use of the Platform by you;

       Any third-party claim arising from your use of the Platform.

This indemnity obligation survives the termination or expiry of your membership.

 

23. Account Suspension and Termination

23.1  Termination by You

You may close your account and terminate your membership at any time by contacting us at info@oceaniamatrimony.com.au. Upon voluntary termination, you will not be entitled to a refund of any unused subscription period, except where your statutory rights under the ACL apply.

23.2  Termination by Us

We reserve the right to suspend, restrict, or permanently terminate your account and membership — with or without notice — if we reasonably believe you have:

       Breached any provision of these Terms;

       Provided false, misleading, or fraudulent information in your profile;

       Engaged in conduct that harasses, abuses, or threatens any other member or staff member;

       Created duplicate profiles in violation of Section 3.4;

       Engaged in any fraudulent, unlawful, or criminal activity through the Platform;

       Posed a risk to the safety or wellbeing of any other member or the Platform;

       Uploaded AI-generated, synthetic, or manipulated content in breach of Section 10.

 

If we terminate your account for breach of these Terms, you will not be entitled to a refund of any subscription fees paid.

23.3  Effect of Termination

Upon termination of your membership, your right to access the Platform and all its features ceases immediately. All provisions of these Terms that by their nature should survive termination — including disclaimers, indemnity, and limitation of liability — will continue in full force.

 

24. Disputes Between Members

Oceania Matrimony is not a party to, and accepts no responsibility or liability for, any dispute, disagreement, or claim that arises between members — including disputes arising from communications, meetings, financial transactions, or matrimonial negotiations.

 

Members are solely responsible for their own conduct and communications with other members, whether on or off the Platform. We strongly advise all members to involve their family, exercise due diligence, and take appropriate legal or professional advice before entering into any matrimonial agreement.

If you believe another member has engaged in conduct that violates these Terms, you may report it to us at info@oceaniamatrimony.com.au. We will review all reports and take appropriate action at our discretion.

 

25. Governing Law and Dispute Resolution

25.1  Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Western Australia and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of the courts of Western Australia and the Federal Court of Australia.

25.2  Dispute Resolution Process

In the event of a dispute between you and Oceania Matrimony, we encourage you to contact us first at info@oceaniamatrimony.com.au to seek an amicable resolution. We will attempt to resolve all disputes within 30 days of notification.

If the dispute cannot be resolved directly, either party may refer the matter to mediation administered by a mutually agreed mediator, or to the relevant Australian consumer tribunal. Nothing in these Terms prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.

26. Changes to These Terms

We may update these Terms from time to time to reflect changes in Australian law, technology, or our business practices. Material changes will be communicated by email or a prominent notice on the Platform at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes your acceptance of the revised Terms.

27. Miscellaneous Provisions

       Entire Agreement: These Terms, together with our Privacy Policy, Refund Policy, Child Safety Policy, and Cookie Policy, constitute the entire agreement between you and Oceania Matrimony.

       Severability: If any provision is found to be unlawful or unenforceable, it will be severed without affecting the validity of the remaining provisions.

       Waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in future.

       Assignment: You may not assign your rights or obligations under these Terms. We may assign our rights to a related entity or successor in connection with a merger, acquisition, or sale of business assets.

       Force Majeure: We are not liable for failure to perform our obligations where such failure results from circumstances beyond our reasonable control.

       Language: These Terms are written in English. English prevails over any translation.

       No Marriage Guarantee: Registration on the Platform does not constitute any guarantee, recommendation, or assurance of a matrimonial match or marriage.

       No Dowry: Oceania Matrimony does not endorse, facilitate, or encourage any dowry or gift exchange arrangement. We accept no commission or brokerage from members in relation to any match.
